These Terms of Service (“Terms”) govern your use of BorderlessPro’s freelance hiring and talent sourcing services. By engaging with our platform, requesting a proposal, or accepting any of our packages, you agree to these terms.
1. Services Provided
BorderlessPro connects businesses with pre-vetted freelance talent through done-for-you hiring services. Our offerings include:
- Role definition and intake
- Talent sourcing and vetting
- Shortlisting and introductions
- Optional onboarding support
All hires are facilitated directly between you and the freelancer unless otherwise arranged.
2. Client Responsibilities
You agree to:
- Provide accurate information regarding role needs and budget
- Engage with the hiring process in a timely manner
- Manage freelance contracts and payments directly unless retained support is included
3. Payment and Refunds
- All packages are paid upfront unless a custom agreement is signed
- We accept MPESA, bank transfer, or card payments
- No refunds are issued once sourcing begins
- For retainers, billing occurs monthly and is non-refundable
4. Candidate Use and Confidentiality
- Candidates sourced for you are not to be shared or repurposed outside of your company
- Profiles are exclusive to your company for 14 days after delivery
- All candidate data must be treated as confidential
5. Replacement Guarantee
If a hired freelancer leaves or is terminated within 14 days (excluding changes in scope or pay), BorderlessPro will provide one replacement free of charge.
6. Non-Circumvention
By engaging our services, you agree not to bypass BorderlessPro to hire freelancers introduced to you through our platform, for a period of 12 months.
Violations may incur a buyout fee equal to 20% of the freelancer’s annualized compensation.
7. Disclaimer of Guarantees
While we rigorously vet talent, performance outcomes post-hire are not guaranteed. Final hiring decisions are your responsibility.
8. Intellectual Property
All materials provided by BorderlessPro (documents, guides, proposals) are the intellectual property of BorderlessPro and may not be republished, redistributed, or sold without written permission.
9. Limitation of Liability
BorderlessPro is not liable for any losses, delays, or damages arising from freelancer engagements unless explicitly agreed in a service-level agreement.
10. Governing Law
These Terms are governed by the laws of the Republic of Kenya. Any disputes shall be subject to arbitration in Mombasa.
11. Updates to Terms
We may update these Terms periodically. Continued use of our services after changes means you accept the updated terms.
